Contractor Categorization
The Roads Directorate Act, 2010, requires the Roads Directorate to undertake assessment and classification of road contractors and to maintain a register of categorised contractors.
Reforms in the roads subsector in Lesotho brought about increased participation of the private sector in the construction and maintenance of the roads infrastructure. In order to plan for effective use of the private sector the available capacity has to be assessed properly.

Initial Application

This type of application takes place twice every year. New applicants are categorized within six months of submitting their applications.

Application Renewal

Renewal of applications take two forms which are classified thus:
a) Renewal of categorization certificate: certificate is renewed annually at the prescribed fee.

b) Renewal of company category: an in-depth renewal which takes place once in three years. The process involves a re-assessment of the company status to determine the capacity as to whether it is still viable for consideration under the awarded class or category of contractor level.

Application for Upgrading

To enable the growth in the road construction industry, a contractor may at any given time apply for the upgrading to a higher category. The application will still be assessed to determine whether the company meets the criteria set for the category applied for.

An applicant shall be required to attach the following documents to their application forms:
a) Confirmation of the legal status of the applicant If an applicant is a legal persona, proof of legal registration shall be required
b) Traders’ licence
A valid trader’s licence shall be required
c) Tax clearance certificate
A valid tax clearance certificate shall be required
d) Identification of ownership
The applicant shall produce identification documents for all shareholders.
i) If an applicant is a natural person, an identification document has to be attached
ii) If the applicant is legal person (company/legal entity), a confirmation of legal status and identity documents of shareholders must be attached
e) Lease or sub-lease agreement
This parameter of lease or sub-lease applies to applicants for categories A, B, and C only
